Process of advocacy for physicians

A member can appeal to CAPA president or site representatives re:

  • unsatisfactory performance review*

  • unrequested change in privileges

  • termination of privileges

  • suspension of privileges

  • unsatisfactory working conditions*

  • refusal of LOA**

  • refusal of appointment to Calgary Health Region department

  • any other significant issue regarding physician rights. Currently we have no process in place to decide what is a "significant issue.”*

Currently there is no formal way for the CAPA to be involved. We should discuss whether to become involved on application from a member - should there be any time minimum on how long the physician has been resident in the region?

Privileging issues

All changes in privileges must come before the MAB. In cases of disputed refusal or downgrading, the MAB must transmit to the applicant (by double registered mail) the concerns prompting the contemplated rejection or modification, and invite the applicant to make a written or verbal (or both) submission to the MAB at its next meeting. The decision must therefore be tabled to the next meeting. The applicant must respond in writing before the next MAB and be given at least 14 day to do so. (See Article 3.1.5.3) This process is repeated by the CHR board if they agree with the MAB recommendations to deny or downgrade privileges. (See attached flow chart).

APPEALS COMMITTEE (ARTICLE 7.4.1)

The appeals committee shall only hear appeals based on:
i) An allegation that due process for discipline has not been followed
ii) New evidence.

Members are elected by the medical staff or appointed by the CAPA executive. The president of the CAPA calls meetings on request of a senior medical officer, chief medical officer or member of the medical staff. Must meet within 14 days after receipt of request by an appellant. The appellant has the right to appear before the committee, and also be represented by legal counsel.

N.B. Bylaw 3.5.1. The Calgary Health Region shall notify the College of Physicians and Surgeons of Alberta whenever a member is suspended or privileges canceled or materially altered because of incompetence, negligence or misconduct, or if the member resigns voluntarily or under coercion while under investigation for above.
